Terms of Service

1. Acceptance of Terms
By accessing or using the PoolCamp platform, including the website at poolcampai.com, the web application, and the mobile applications (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
“PoolCamp,” “we,” “us,” and “our” refer to PoolCamp Inc. “You” and “your” refer to the individual or entity using the Service.
2. Description of Service
PoolCamp is a pool service software platform that provides route optimization, chemical tracking, scheduling, invoicing, technician management, customer communication, and related tools designed for pool service businesses. We may update, modify, or discontinue features of the Service at any time.
3. Account Registration
To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the entity you represent.
4. Free Trial
We may offer a free trial period at our discretion. During the trial, you will have access to the full Service. At the end of the trial period, your account will be converted to a paid subscription unless you cancel before the trial ends. We reserve the right to modify or discontinue the free trial at any time.
5. Subscription & Billing
The Service is offered on a subscription basis. Subscription fees are billed in advance on a monthly or annual cycle depending on the plan you select. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
We reserve the right to change pricing with 30 days' written notice. Price changes will take effect at the start of your next billing cycle. If you do not agree to the new pricing, you may cancel before the change takes effect.
Payment processing is handled by Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.
6. Your Data
You retain all rights to the data you enter into the Service (“Your Data”). You grant PoolCamp a limited license to use, process, and store Your Data solely to provide and improve the Service. We will not sell Your Data to third parties.
You may export Your Data at any time through the Service. If you close your account, we will provide a reasonable opportunity to export Your Data before deletion.
You are solely responsible for the accuracy and legality of Your Data and for obtaining any necessary consents from your customers or end users whose information you enter into the Service.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service to transmit malicious code, spam, or harmful content.
- Resell, sublicense, or redistribute the Service without our written consent.
8. Intellectual Property
The Service, including all software, designs, text, graphics, logos, and other content, is the property of PoolCamp Inc. and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service in accordance with these Terms.
9. Limitation of Liability
To the maximum extent permitted by law, PoolCamp and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from or related to your use of the Service.
Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Termination
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of your paid period.
We may suspend or terminate your account if you violate these Terms, fail to pay fees, or if we reasonably believe your use poses a risk to the Service or other users. We will provide notice where practicable.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. Any disputes arising from these Terms will be resolved in the state or federal courts located in Delaware.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
